Partner visas are for people who are partners of Australian citizens, permanent residents of Australia, or eligible New Zealand citizens. These visas enable partners to live in Australia, typically on a temporary basis initially, and can lead to a permanent visa. The options available include the onshore Partner Visa Subclass 820/801, the offshore Partner Visa Subclass 309/100, and the Prospective Marriage Visa Subclass 300
Partner Visas
Subclasses 820/801 and 309/100
The visa Subclasses 820/801 and 309/100 allow people to live in Australia with their eligible partner.
You must be in a genuine, committed and exclusive marriage or de facto relationship with an Australian citizen, permanent resident or eligible New Zealand citizen. Your partner will need to sponsor you.
The circumstances of your relationship will be taken into account when determining if your relationship is genuine and meets the eligibility criteria for a partner visa. Circumstances considered include the financial and social aspects of your relationship, the nature of the household and your commitment to each other. If unmarried, there are generally requirements related to the length of the relationship.
The sponsor must also meet eligibility requirements to sponsor their partner. There is a limit to the number of people that the sponsor can have sponsored in the past, as well as the time that has passed since sponsoring a previous partner. The sponsor must provide a police check. Some offences can make a person ineligible to sponsor. However, sometimes requirements can be waived for compelling circumstances.
With the visa Subclasses 820/801 and 309/100, you can stay in Australia, work, and you will be eligible for many Australian benefits, such as Medicare. Most people need to hold a temporary partner visa for two years; after this, they can apply for a permanent partner visa.
There are some exceptions to the requirement of waiting two years with a temporary partner visa before receiving a permanent partner visa. For example, if you have been in a relationship for three years, you may not need to hold a temporary partner visa for two years before receiving a permanent visa.

Prospective Marriage Visa
Subclass 300
The Subclass 300 visa allows people to come to Australia to marry their partner.
You must be over 18. You must be outside Australia when you apply for this visa and plan to come to Australia to marry an Australian citizen, permanent resident or eligible New Zealand citizen. You must be legally permitted to marry. You must have physically met the person you plan to marry in Australia. The person you intend to marry must sponsor you.
The sponsor must also meet eligibility requirements to sponsor their partner. There is a limit to the number of people that the sponsor can have sponsored in the past, as well as the time that has passed since sponsoring a previous partner. The sponsor must provide a police check. Some offences can make a person ineligible to sponsor. However, sometimes requirements can be waived for compelling circumstances.
With the Subclass 300 visa, you can stay in Australia until you marry. The time allowed before you must marry after your visa is granted is usually nine months. You can work and study. After marriage, you can apply for a partner visa to remain in Australia
